Couple hurt in El Paso shooting sues Walmart for negligence

A Texas couple injured in the El Paso shooting has filed a lawsuit against Walmart — where the Aug. 3 massacre took place — claiming it failed to protect them by not having any armed security guards at the store.

“Jessica Garcia and Guillermo Garcia’s injuries would not have occurred but for the negligence, gross negligence, and premises liability” of Walmart, the suit says.

The couple was shopping at the El Paso store with their two children when accused gunman Patrick Crusius went on his shooting rampage. Their lawsuit appears to be the first filed over the attack.

Guillermo had to be hospitalized after being shot in the spine, and Jessica was also treated for bullet wounds to her legs. Their lawyers gave an update on their conditions Wednesday, saying Guillermo was still recovering and in critical condition, while Jessica had been released from the hospital.

The couple plans to argue that Walmart was responsible for their injuries because they failed to employ armed security guards at the El Paso location, like they do at many other stores. Their lawsuit does not say whether they are seeking any monetary damages.
